General Terms and Conditions of Sale, Delivery, and Payment

1.1 These General Terms and Conditions of Sale (hereinafter referred to as “GTCS”) apply to all purchase agreements concluded via the online shop between us and our customers, including offers and order confirmations.

1.2 The GTCS apply to natural persons as defined in § 13 of the German Civil Code (BGB) who conclude the contract for purposes that are predominantly outside their trade, business or profession (hereinafter: “Consumer”).

2.1 The presentation of products in the online shop does not constitute a legally binding offer from us, but a non-binding invitation to the customer to submit a purchase offer.

2.2 To place an order, the customer must complete the following steps:

(a) Select the desired products and quantities by clicking “Order Now” or “Add to Cart”.

(b) Click “Checkout” and enter all required information: name, e‑mail, address, delivery method, and payment method.

(c) On the “Order Overview” page, review and, if needed, modify the provided information and products.

(d) Click “Place Order with Obligation to Pay” to submit a legally binding purchase offer (§ 145 BGB).

2.3 We will immediately confirm receipt of the order by e‑mail (“Order Confirmation”). This confirmation does not constitute acceptance of the offer but merely informs the customer that the order was received.

2.4 The purchase contract is only concluded when we send a contract confirmation or dispatch the goods. We store the contract text.

2.5 The customer may print and/or save the contract text and the GTCS.

2.6 The contract language is German.

2.7 The prices are those published on www.eichmueller.de at the time of the order. They include VAT and shipping costs (“+ shipping”). The total price is displayed before the order is placed.

If the customer is a consumer, the following applies:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party designated by you (other than the carrier) has taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Richard Eichmüller, Blieskastelstr. 6, 81379 Munich, Germany, widerruf@eichmueller.de, phone: +49 89 17959600, fax: +49 89 179596030) by means of a clear statement (e.g. letter, fax, or e-mail). You may use the attached model withdrawal form, but it is not required.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse you for all payments received from you, including the cost of standard delivery (except for additional costs from choosing a different delivery method), without undue delay and no later than fourteen days from the day we are informed of your decision to withdraw.

We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise. You will not be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.

You must return the goods promptly and in any event not later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

4.1 We accept advance payment and PayPal Plus (PayPal, credit card, direct debit, and invoice).

4.2 For PayPal payments, the customer is redirected to the PayPal website, logs in, and confirms the payment.

4.3 Payment processing is handled via PayPal (Europe) S.à.r.l. et Cie, Luxembourg. For more details, refer to PayPal’s terms. We do not store credit card or account data.

4.4 The purchase price and shipping fees are due upon conclusion of the contract.

The goods remain our property until full payment has been received.

The customer may only exercise a right of retention if their claim arises from the same contractual relationship.

Legal warranty rights apply. Our liability for damages is limited unless otherwise stated in section 9.

9.1 We are liable for intent and gross negligence. For slight negligence, we are only liable for foreseeable damages.

We take data protection seriously. Data is processed in accordance with the GDPR. Full details can be found in our privacy policy: link.

German law applies, excluding the UN Sales Convention (CISG). If the customer has their habitual residence outside Germany but within the EEA, this does not affect the applicability of mandatory consumer protection laws of that country. Place of jurisdiction is Memmingen, Germany.

The European Commission provides a platform for online dispute resolution (ODR): link. We do not participate in dispute resolution before a consumer arbitration board.
